PECR – Privacy and Electronic Communications Regulations 2003

The Privacy and Electronic Communications Regulations set out rules in a number of areas.

The marketing rules apply if you are sending marketing and advertising by electronic means, such as by telephone, fax, email, text, picture or video message, or by using an automated calling system.

There are also rules which apply if you use cookies or similar technology to track information about end users of a website or electronic service, or want to compile a public directory (eg a telephone directory or directory enquiry service).

If you provide communications services, there are other rules on line identification, traffic data, location data, and security of the service.
